Supervolcanoes may have shorter fuse

A doomsday volcanic eruption with the power to wipe out civilization may sound like the premise for a bad movie, but so-called supervolcanoes are far from fictional. And now scientists are warning that supervolcanoes require far less time to build up the ammunition for a cataclysmic eruption than once thought.

However, this newly discovered "short fuse" must be put in context: The buildup of a supervolcano toward eruption still may take several hundred or thousands of years.

There are quite a few supervolcanoes around the world, from the one in Yellowstone Park to what could be a new supervolcano in Bolivia. While none of them appears primed for an eruption, understanding their behavior illuminates Earth's past and gives a better picture of the danger they pose.

Supervolcano short fuse
Previous studies indicated that supervolcanoes ? volcanoes that spew out roughly 1,000 times more material than Mount St. Helens did in 1980 ? need 100,000 to 200,000 years to build up a reservoir of magma before they can unleash a violent eruption.

Yet research published May 30 in the journal PLoS ONE suggests that these giant magma pools, typically 10 to 25 miles across, exist for only a few thousand to even just a few hundred years before a supervolcano goes off.

"Our study suggests that when these exceptionally large magma pools form, they are ephemeral and cannot exist very long without erupting," Guilherme Gualda, an assistant professor of earth and environmental sciences at Vanderbilt University, said in a statement.

Gualda and colleagues studied Bishop Tuff, a plateau in California that is essentially the remains of a supervolcano that erupted about 760,000 years ago. They used a dating technique that looked at the rate of quartz crystallization ? as opposed to a more traditional method that uses the decay of elements such as uranium and thorium in zircon crystals ? to determine the lifespan of the magma pool that sparked the massive eruption.

The study yielded compelling evidence that the magma pool may have formed in 10,000 years ? and most likely formed in as little as 500 to 3,000 years.

More scrutiny needed
Gualda said that means the world's supervolcanoes may bear closer scrutiny than they now receive. "The fact that the process of magma body formation occurs in historical time, instead of geological time, completely changes the nature of the problem," he said. [ 10 Wild Volcano Facts ]

The most recent super-eruption occurred at Taupo in New Zealand, about 26,000 years ago; the most dramatic to occur while humans walked the Earth happened 74,000 years ago, in Indonesia, when an eruption at Mount Toba rained ash all over South Asia and filled the atmosphere with so great a load of ash and small particles that it altered global weather for as long as a decade.

There are indications that the eruption took a devastating toll on the world's human population.

KING CRIMSON The Power To Believe music review by Sinusoid

5 stars What if the album an artist was meant to create happened almost 35 years into its existence? I almost feel that way with POWER TO BELIEVE, one of King Crimson's most recent studio outputs. It's astounding to hear a band that had slugged it out for that long and many fans claiming their highlight creative period ceased long ago, yet put out probably their peak album. Even if COURT is more historically important, I feel that POWER TO BELIEVE is the King Crimson apex, which speaks volumes for what that group has contributed to music.

It's as if King Crimson had been listening to the bands that they influenced (Tool, Porcupine Tree, etc.) and used their songwriting approaches to freshen up their own material. A good chunk of the album is metallic and abrasive. We get ''Facts of Life'' (Captain Beefheart vocals over industrial rock), the ''darker-side-of-Porcupine-Tree'' song in ''Eyes Wide Open'' and the thick bottom-heavy ''Happy to Be With What You Have to Be Happy With'' taking the cake on the vocal songs (excluding the title motif), all of superb quality that KC can give its audience. Much of the instrumental work is loud and guitar-centric whether it's more metal (''Level Five''), deals with the spider-web guitars of LARKS TONGUES/DISCIPLINE (''Elektrik'') or involves the classic draw of buildup/suspense (''Dangerous Curves''). If you can deal with the sheer force of the album, POWER TO BELIEVE is a pure joy.

Best yet, the title project feels more of a successor to ''Larks' Tongues in Aspic'' than the actual sequels created over the years; the ''Power to Believe'' parts revive old aspects of KC without sounding tributary. We get the melodic percussion workout in the second part, only extended and far more exciting. And the coda is merely a mellotron wash, but done in such a fantastic way that it avoids being clich?d prog. That's very difficult to pull off when you've heard every prog band and their brother use the thing.

This is the King Crimson album that fully balances their artistic vision and pure enjoyability. I cannot think of another King Crimson album that does this mix and does it well. Maybe KC hasn't hit its peak yet, but I'd imagine POWER TO BELIEVE is insanely close to it.

U.S. Securities and Exchange Commission investigators have concluded their probe of possible financial fraud at Lehman Brothers Holdings Inc. and determined that they will probably not recommend any enforcement action against the firm or its former executives, according to an excerpt of an internal agency memo.

The agency has been grappling with the case for more than three years amid questions from lawmakers and investors as to whether Lehman misrepresented its financial health before filing the biggest bankruptcy in U.S. history in September 2008.

Under a heading reading ?Activity in the Last Four Weeks,? the undated document reads, ?The staff has concluded its investigation and determined that charges will likely not be recommended.?

(AP) ? Director Jeff Nichols wraps up the competition lineup at Cannes wading deep in the Mississippi river, with "Mud," a heart-wrenching Mark Twain-inspired tale of a young boy searching to find life's meaning.

The film was in many ways a conventional piece of southern U.S. filmmaking ? with snake bites, shoot outs, a happy ending and even southern-born Reese Witherspoon, as a leg-baring love interest.

It features stellar performances from 15-year-old Tye Sheridan ? who starred in last year's "The Tree of Life" ? and Matthew McConaughey, who wowed critics with one of the festival's best performances.

Along with "Lawless" and "The Paperboy," ''Mud" can be added to the list of southern U.S. films that have graced this year's festival.

Nichols joked: "Well? Southerners are good story-tellers."

Equipment Leases up 20% in April | Point Blank | Direct Capital

The Equipment Leasing and Finance Association, the trade association that represents the equipment finance sector, just released their Monthly Leasing and Finance Index for April of this year.? Overall new equipment volume for April was $6.1 billion, up 20 percent from a year ago.? However, volume is down 10 percent from March, and The Monthly Confidence Index for May is 59.2, also down slightly from April.?

Direct Capital has seen some growth in April on our end as well.? The number of opportunities that were submitted for financing is up 20 percent over last April, while the number of those that were approved is up 25 percent (a 0.7 percent increase?from March) ? indicating that the quality of applicants and perhaps business credit-worthiness is improving.

(AP) ? With another season on the brink, Dwyane Wade and LeBron James took their two-man game to new heights.

Just like that, the Miami Heat and a Big Three-Minus-One are headed back to the Eastern Conference finals.

Wade scored 41 points, James added 28 and the Heat finished off the once-frisky Indiana Pacers 105-93 in Game 6 Thursday night, advancing to face either Boston or Philadelphia in the next round.

The way Miami's dynamic duo is playing, it may not matter who's got next.

"They're going to be tough to beat by anybody," Indiana coach Frank Vogel said.

This was a 4-2 triumph that came down to a trilogy, Wade and James responding with the most remarkable week of their high-powered partnership, just when it looked as though the Heat were down and might be out.

Over the course of three dazzling games, James scored 98 points, grabbed 34 rebounds and dished out 24 assists. Wade had 99 points, 22 rebounds and 11 assists. Chris Bosh, sidelined by an abdominal injury, wasn't missed at all.

"In the regular season, we've had some good games," Wade said. "But I don't know if we've ever had three in a row like that in the playoffs, the way we played off each other."

Of course, nothing less than an NBA title will do in South Beach.

Two series down, two to go.

One week earlier, Miami was down 2-1 after getting thumped 94-75 in Indianapolis. The fired-up Pacers had another game on their home court and a chance to build a commanding lead.

Wade and James simply refused to let it happen.

"We understand that when Chris went out, we had to step up," D-Wade said. "The team looked to us to lead."

The banged-up Heat will get a chance to relax a couple of days before worrying about the next opponent, who will be determined in Game 7 at Boston on Saturday. The conference finals start Monday in Miami.

Bosh hopes to return at some point, but it might not matter.

Not the way Wade and James are playing.

"Chris Bosh is an awesome basketball player, but when he goes down, that just means more touches for LeBron and Wade," Vogel said. "That's not exactly an advantage."

The Heat rallied from an early 11-point deficit, riding the hot hand of Wade in the opening half. He scored 26 points by the break, tying Tim Hardaway's 16-year-old franchise record for most playoff points in the first two quarters. James hit consecutive baskets with just over a minute remaining to close it out.

David West led Indiana with 24 points and all five starters were in double figures. Balance, it turned out, was no match for Wade and James.

"Guys are disappointed but understand that it's not our time yet," West said.

In a game of spurts, the decisive one came in the closing minutes of the third quarter.

The Pacers tied it at 66 on Darren Collison's 3-pointer, but it was all Heat the rest of the period. They closed on a 13-3 run, capped by Mario Chalmers' buzzer-beating 3 from the corner. Wade, who was on the bench getting his customary breather at the end of the quarter, leaped from his seat as the ball left Chalmers' hand at the far end, raced along the baseline and pumped his fist when it swished.

When Chalmers raced toward the Miami bench, Wade greeted him near the free throw line with a low-five.

"We just had a bad stretch," West said. "They got us in the third quarter."

Cheerleading aside, D-Wade did his best work while in the game. He dropped 11-of-16 shooting on the Pacers in the first half, but also made sure the MVP stayed involved, dishing off a behind-the-back pass to James for a thunderous jam.

"They're too good," West said. "They pressure you all over the place."

There was none of the nastiness that marked Game 5, when a bunch of flagrant fouls resulted in suspensions for two Miami players, co-captain Udonis Haslem and backup center Dexter Pittman. Pacers president Larry Bird was so disgusted with his team's performance in a 115-83 loss that he accused them of going "soft."

Toughness wasn't the problem this time. This was merely a Miami team on a mission, a mission that began in the summer of 2010 when the Heat signed James and Bosh to join Wade in a seemingly unbeatable trio. There was a glitzy introduction and predictions of multiple championships, which left the rest of the league seething and plenty of people cheering when Miami was knocked off in the NBA finals by the Dallas Mavericks last season.

Shaking off that disappointment, James had perhaps his greatest season yet. But it was Wade who took control in the decisive game against the Pacers. He sliced into the lane, throwing up a one-handed shot that looked like it might go over the backboard, only to catch the top of the glass and drop through, barely touching the twine. He delivered one final blow when he split West and George Hill, banking in the shot despite taking a knee from Hill that sent the Heat guard tumbling to the court.

"We just didn't have enough yet," Vogel said, "but we'll be back."

Chalmers finished with 15 points, while Mike Miller stepped up to provide some quality minutes, scoring 12 points on four 3-pointers to help fill the void without Haslem, Pittman and Bosh.

When Miller wasn't in the game, he stretched out along the baseline to cope with his various aches and pains, more comfortable that way than sitting in a chair. When coach Erik Spoelstra called his number, Miller summoned several of his teammates to help lift him up.

"He might be the toughest guy on the team," Wade said.

The Big Two aren't too shabby, either.

Notes: Indiana started 8 of 9 from the field, but went just 26 of 61 (43 percent) the rest of the way. ... The Heat held the Pacers to an average of less than 40 points in the second half over the last three games. ... Miami had only 10 turnovers, its fewest in the series.

The push to make the internet a controlled space used to spy on citizens, where supposedly ?private? information is automatically shared with authorities, might soon reach another threshold. A new report suggests that the FBI is currently discussing with major internet companies such as Microsoft, Facebook, Yahoo and Google to build backdoor accesses to their services to facilitate government surveillance. The FBI is also attempting to convince these companies to support an upcoming law that would allow the outright spying of social networks, VoIP, and Web e-mail providers. The law, like many other similar ones that are being proposed and adopted, is in direct violation with the 4th Amendment, which states: ?The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.?

Of course, those who wrote the Bill of Rights were not expecting the advent of the internet and the storing of information on remote servers. The application of its principles is however nebulous today. However, if those in power truly wished (and if citizens somewhat cared) to preserve the spirit of the Amendment (which was created to protect citizens from government oppression and tyranny) they would have extended the principles of the Fourth Amendment to cyberspace. We are however witnessing the exact opposite: The advent of the internet, of social networks and other technologies appears to be the perfect opportunity for state authorities to deny these historic rights to citizens and to move towards a high tech police state.

FBI: We need wiretap-ready Web sites ? now

CNET learns the FBI is quietly pushing its plan to force surveillance backdoors on social networks, VoIP, and Web e-mail providers, and that the bureau is asking Internet companies not to oppose a law making those backdoors mandatory.

The FBI is asking Internet companies not to oppose a controversial proposal that would require firms, including Microsoft, Facebook, Yahoo, and Google, to build in backdoors for government surveillance.

In meetings with industry representatives, the White House, and U.S. senators, senior FBI officials argue the dramatic shift in communication from the telephone system to the Internet has made it far more difficult for agents to wiretap Americans suspected of illegal activities, CNET has learned.

The FBI general counsel?s office has drafted a proposed law that the bureau claims is the best solution: requiring that social-networking Web sites and providers of VoIP, instant messaging, and Web e-mail alter their code to ensure their products are wiretap-friendly.

?If you create a service, product, or app that allows a user to communicate, you get the privilege of adding that extra coding,? an industry representative who has reviewed the FBI?s draft legislation told CNET. The requirements apply only if a threshold of a certain number of users is exceeded, according to a second industry representative briefed on it.

The FBI?s proposal would amend a 1994 law, called the Communications Assistance for Law Enforcement Act, or CALEA, that currently applies only to telecommunications providers, not Web companies. The Federal Communications Commission extended CALEA in 2004 to apply to broadband networks.

FBI Director Robert Mueller is not asking companies to support the bureau?s CALEA expansion, but instead is ?asking what can go in it to minimize impacts,? one participant in the discussions says. That included a scheduled trip this month to the West Coast ? which was subsequently postponed ? to meet with Internet companies? CEOs and top lawyers.

A further expansion of CALEA is unlikely to be applauded by tech companies, their customers, or privacy groups. Apple (which distributes iChat and FaceTime) is currently lobbying on the topic, according to disclosure documents filed with Congress two weeks ago. Microsoft (which owns Skype and Hotmail) says its lobbyists are following the topic because it?s ?an area of ongoing interest to us.? Google, Yahoo, and Facebook declined to comment.

In February 2011, CNET was the first to report that then-FBI general counsel Valerie Caproni was planning to warn Congress of what the bureau calls its ?Going Dark? problem, meaning that its surveillance capabilities may diminish as technology advances. Caproni singled out ?Web-based e-mail, social-networking sites, and peer-to-peer communications? as problems that have left the FBI ?increasingly unable? to conduct the same kind of wiretapping it could in the past.

In addition to the FBI?s legislative proposal, there are indications that the Federal Communications Commission is considering reinterpreting CALEA to demand that products that allow video or voice chat over the Internet ? from Skype to Google Hangouts to Xbox Live ? include surveillance backdoors to help the FBI with its ?Going Dark? program. CALEA applies to technologies that are a ?substantial replacement? for the telephone system.

?We have noticed a massive uptick in the amount of FCC CALEA inquiries and enforcement proceedings within the last year, most of which are intended to address ?Going Dark? issues,? says Christopher Canter, lead compliance counsel at the Marashlian and Donahue law firm, which specializes in CALEA. ?This generally means that the FCC is laying the groundwork for regulatory action.?

Subsentio, a Colorado-based company that sells CALEA compliance products and worked with the Justice Department when it asked the FCC to extend CALEA seven years ago, says the FBI?s draft legislation was prepared with the compliance costs of Internet companies in mind.

In a statement to CNET, Subsentio President Steve Bock said that the measure provides a ?safe harbor? for Internet companies as long as the interception techniques are ??good enough? solutions approved by the attorney general.?

Another option that would be permitted, Bock said, is if companies ?supply the government with proprietary information to decode information? obtained through a wiretap or other type of lawful interception, rather than ?provide a complex system for converting the information into an industry standard format.?

A representative for the FBI told CNET today that: ?(There are) significant challenges posed to the FBI in the accomplishment of our diverse mission. These include those that result from the advent of rapidly changing technology. A growing gap exists between the statutory authority of law enforcement to intercept electronic communications pursuant to court order and our practical ability to intercept those communications. The FBI believes that if this gap continues to grow, there is a very real risk of the government ?going dark,? resulting in an increased risk to national security and public safety.?

Next steps
The FBI?s legislation, which has been approved by the Department of Justice, is one component of what the bureau has internally called the ?National Electronic Surveillance Strategy.? Documents obtained by the Electronic Frontier Foundation show that since 2006, Going Dark has been a worry inside the bureau, which employed 107 full-time equivalent people on the project as of 2009, commissioned a RAND study, and sought extensive technical input from the bureau?s secretive Operational Technology Division in Quantico, Va. The division boasts of developing the ?latest and greatest investigative technologies to catch terrorists and criminals.?

But the White House, perhaps less inclined than the bureau to initiate what would likely be a bruising privacy battle, has not sent the FBI?s CALEA amendments to Capitol Hill, even though they were expected last year. (A representative for Sen. Patrick Leahy, head of the Judiciary committee and original author of CALEA, said today that ?we have not seen any proposals from the administration.?)

Mueller said in December that the CALEA amendments will be ?coordinated through the interagency process,? meaning they would need to receive administration-wide approval.

Stewart Baker, a partner at Steptoe and Johnson who is the former assistant secretary for policy at Homeland Security, said the FBI has ?faced difficulty getting its legislative proposals through an administration staffed in large part by people who lived through the CALEA and crypto fights of the Clinton administration, and who are jaundiced about law enforcement regulation of technology ? overly jaundiced, in my view.?

On the other hand, as a senator in the 1990s, Vice President Joe Biden introduced a bill at the FBI?s behest that echoes the bureau?s proposal today. Biden?s bill said companies should ?ensure that communications systems permit the government to obtain the plain text contents of voice, data, and other communications when appropriately authorized by law.? (Biden?s legislation spurred the public release of PGP, one of the first easy-to-use encryption utilities.)

The Justice Department did not respond to a request for comment. An FCC representative referred questions to the Public Safety and Homeland Security Bureau, which declined to comment.

From the FBI?s perspective, expanding CALEA to cover VoIP, Web e-mail, and social networks isn?t expanding wiretapping law: If a court order is required today, one will be required tomorrow as well. Rather, it?s making sure that a wiretap is guaranteed to produce results.

But that nuanced argument could prove radioactive among an Internet community already skeptical of government efforts in the wake of protests over the Stop Online Piracy Act, or SOPA, in January, and the CISPA data-sharing bill last month. And even if startups or hobbyist projects are exempted if they stay below the user threshold, it?s hardly clear how open-source or free software projects such as Linphone, KPhone, and Zfone ? or Nicholas Merrill?s proposal for a privacy-protective Internet provider ? will comply.

The FBI?s CALEA amendments could be particularly troublesome for Zfone. Phil Zimmermann, the creator of PGP who became a privacy icon two decades ago after being threatened with criminal prosecution, announced Zfone in 2005 as a way to protect the privacy of VoIP users. Zfone scrambles the entire conversation from end to end.

?I worry about the government mandating backdoors into these kinds of communications,? says Jennifer Lynch, an attorney at the San Francisco-based Electronic Frontier Foundation, which has obtained documents from the FBI relating to its proposed expansion of CALEA.

As CNET was the first to report in 2003, representatives of the FBI?s Electronic Surveillance Technology Section in Chantilly, Va., began quietly lobbying the FCC to force broadband providers to provide more-efficient, standardized surveillance facilities. The FCC approved that requirement a year later, sweeping in Internet phone companies that tie into the existing telecommunications system. It was upheld in 2006 by a federal appeals court.

But the FCC never granted the FBI?s request to rewrite CALEA to cover instant messaging and VoIP programs that are not ?managed??meaning peer-to-peer programs like Apple?s Facetime, iChat/AIM, Gmail?s video chat, and Xbox Live?s in-game chat that do not use the public telephone network.

If there is going to be a CALEA rewrite, ?industry would like to see any new legislation include some protections against disclosure of any trade secrets or other confidential information that might be shared with law enforcement, so that they are not released, for example, during open court proceedings,? says Roszel Thomsen, a partner at Thomsen and Burke who represents technology companies and is a member of an FBI study group. He suggests that such language would make it ?somewhat easier? for both industry and the police to respond to new technologies.

But industry groups aren?t necessarily going to roll over without a fight. TechAmerica, a trade association that includes representatives of HP, eBay, IBM, Qualcomm, and other tech companies on its board of directors, has been lobbying against a CALEA expansion. Such a law would ?represent a sea change in government surveillance law, imposing significant compliance costs on both traditional (think local exchange carriers) and nontraditional (think social media) communications companies,? TechAmerica said in e-mail today.

Ross Schulman, public policy and regulatory counsel at the Computer and Communications Industry Association, adds: ?New methods of communication should not be subject to a government green light before they can be used.?

Such unprecedented speeds on the wireless platform are now a reality as scientists from the Nanyang Technological University (NTU) and A*STAR's Institute for Infocomm Research (I?R) have developed a revolutionary microchip that can transmit large volumes of data at ultra-high speeds of 2 Gigabits per second (or 1,000 times faster than Bluetooth^).

The chipset employs wireless millimeter-wave (mm-wave) technology to transmit large packets of information while consuming little power. This enables low-power applications, like smart phones and tablets, to transmit/receive data between platforms, like projectors and TVs, without the need for cables for the very first time.

"The demand for ultra high-speed wireless connectivity has fueled the need for faster data transfer rates. Unfortunately, current technologies are unable to meet these stringent demands. How the VIRTUS chipset works

Named the VIRTUS chipset, it consists of three components: an antenna, a full radio-frequency transceiver (developed by NTU) and a baseband processor (developed by I?R). The antenna is connected to the transceiver, which filters and amplifies the signals. It then passes the signals to the baseband processor, which comprises non-linear analog signal processing and unique digital parallel processing and decoder architecture -- key to lower power consumption.

The team of scientists from NTU and I?R is the first in the world to successfully put together an integrated low-power 60 Gigahertz (GHz) chipset solution consisting of the three components, making it one step closer to commercialisation. It is also the first team to demonstrate one of the technology's applications -- in the form of a high-definition wireless video stream.

The VIRTUS chipset has garnered 16 international patents. It has also been featured in 51 top-tier international journal and conference papers, on top of its other international accolades such as two best paper awards and two best chip design awards.

"This ground-breaking mm-wave integrated circuit (IC) technology will have significant commercial impact, enabling a wide range of new applications such as wireless display, mobile-distributed computing, live high-definition video streaming, real-time interactive multi-user gaming, and more," added NTU's Prof Yeo, who is also founding director of NTU's VIRTUS IC Design Centre of Excellence.

The collaboration, which began in December 2009, was funded by A*STAR's technology transfer arm, Exploit Technologies Pte Ltd. The team has been approached by leading players and global brand names in the electronics and semiconductor industry to develop the chipset commercially. It will also showcase the technology at a leading technical innovation event in June this year -- Computex (Taiwan).

Facebook investors could recoup losses in court

CNBC's Jane Wells talks to people in Silicon Valley to get their take on Facebook's IPO and its impact on future IPOs.

Retail investors with dreams of instant wealth who bought Facebook shares on opening day may have been disappointed, but they could still wind up with a windfall if lawyers seeking class-action status for lawsuits against the company and its IPO underwriters get their way.

A pair of lawsuits filed in New York and California allege that retail investors were harmed when material information about the company's finances weren't disclosed to them. ?

Experts in securities law have said whether or not plaintiffs will be able to recoup their trading floor losses in a courtroom will depend on the fine print of securities regulations.?What Facebook and its underwriters, including primary underwriter Morgan Stanley, which declined to comment on the suits, knew, and when and to whom they provided information, are the issues on which both lawyers and regulators are focusing.

"It sounds like this is where that case is going to be one of the battlefields," said?David Buckner, a partner at law firm Grossman Roth P.A., whose expertise is in class action suits and securities litigation. "Who has an obligation to speak to who ? that's something that will end up being important."?

Following a Congressional hearing on Tuesday, Securities and Exchange Commission chair Mary Schapiro said, "I think there is a lot of reason to have confidence in our markets and in the integrity of how they operate, but there are issues that we need to look at specifically with respect to Facebook."

Facebook did warn would-be investors of potential challenges to its revenue stream triggered by an increase in mobile users and Facebook's still-poor ability to monetize its mobile base. In an uncharacteristic amendment to its S.E.C. filing just over a week before its IPO, the company warned that these factors had the ability to hurt profits.?

Investors who feel burned and are pursuing legal action contend that the company's cautionary statements weren't specific enough, that Facebook knew that this issue was having more of a negative impact than it let on in the filing, and it tipped its hand only to its underwriters and a handful of analysts.?

"The real issue is how adequate a warning was the May 9 registration statement language," said?Merritt B. Fox, law professor at Columbia University. "Without?knowing the facts, it's hard to know if what the analysts were doing was simply interpreting information that was in the May 9 statement or whether they had additional information to suggest that things were worse."

The Wall Street Journal cited unnamed sources saying Facebook executives contacted nearly two dozen analysts following that amendment and let them ask questions about it. The lawsuits assert that this communication amounted to material information which Facebook, which has said it will defend itself "vigorously," was legally obligated to share with all investors.

"It wasn't the prospect" of future losses, said?David Rosenfeld, an attorney at Robbins Geller Rudman & Dowd, a law firm representing plaintiffs in a suit filed in U.S. District Court in Manhattan on Wednesday.?"They already knew? and they told their underwriters," he said.

Egyptians vote in historic election

Egyptians voted Wednesday in the country's first free presidential elections, with Islamists and secularists vying for power with competing visions of an Egypt free of ousted dictator Hosni Mubarak's iron grip.

Several hours after polls opened at 08:00 am (0600 GMT), there were still lines of people waiting to vote, many in a festive mood.

"It's a beautiful day for Egypt," said Nehmedo Abdel Hadi, who was voting at the Omar Makram school in Cairo's Shubra neighbourhood.

"Now I feel this is my country and I have dignity," said the 46-year-old woman, who wears a full-face veil.

Across the city, in the leafy Mohandesseen neighbourhood, Rania, wearing gym clothes and a ponytail under her baseball cap, was at the front of the line.

"It's the first time in Egypt's history we choose our president," she said, preferring to keep her choice "a secret between me and my ballot box."

More than 50 million eligible voters have been called to choose one of 12 candidates wrestling to succeed ousted president Hosni Mubarak.

Voting over two days is taking place at 13,000 polling stations, with initial results expected on Sunday. Voting ends at 8:00 pm (1800 GMT) on both days.

A senior interior ministry official said police were on standby across the country and helping soldiers secure polling stations.

Security sources told AFP that at one polling station in the Rod al-Farag neighbourhood in northeast Cairo, a policeman was shot dead when he was caught up in a gunfight between supporters of two candidates.

It was not immediately clear which candidates those involved in the altercation were backing, but the incident underscored concerns about security.

Later the interior ministry said the incident was not related to the presidential election and occurred the previous night.

"Police officers were on a routine patrol in Rod al-Farag when they heard gunshots and went to inspect. One policeman was caught in a gunfight and was shot dead," a senior official told AFP.

The incident "was not related to the election, this was a regular fight," he said.

The election marks the final phase of a tumultuous transition overseen by the ruling military council after Mubarak ouster in a popular uprising last year.

Pollsters say the large number of voters undecided between candidates reflecting radically different trends, and the novelty of a free presidential vote, make Wednesday's election almost impossible to call.

Leading contenders include former foreign minister and Arab League chief Amr Mussa, who is seen as an experienced politician and diplomat but like Ahmed Shafiq, Mubarak's last prime minister, is accused of belonging to the old regime.

The powerful Muslim Brotherhood's candidate Mohammed Mursi faces competition from Abdel Moneim Abul Fotouh, a former member of the Islamist movement who portrays himself as a consensus choice with a wide range of support.

The next president will inherit a struggling economy, deteriorating security and the challenge of uniting a nation divided by the uprising and its sometimes deadly aftermath, but his powers are yet to be defined by a new constitution.

Islamist candidates have promised an Islamic-based project that has prompted fears among secularists and Egypt's Coptic minority over personal freedoms and raised questions about the future of the country's lucrative tourism industry.

Shafiq and Mussa have vowed to maintain stability and restore law and order but their ties to the old regime sparked fears of renewed protests by those who will feel their revolution threatened.

The election caps a rollercoaster transition, marked by political upheaval and bloodshed, but which also witnessed democratic parliamentary elections that saw Islamist groups score a crushing victory.

The ruling Supreme Council of the Armed Forces (SCAF), in power since Mubarak's ouster, has urged Egyptians to turn out en masse to the polls, while warning against any "violation."

The SCAF has vowed to hand power to civilian rule by the end of June, after a president is elected, but many fear its retreat will be just an illusion.

The army, with its vast and opaque economic power, wants to keep its budget a secret by remaining exempt from parliamentary scrutiny, maintain control of military-related legislation and secure immunity from prosecution.

Mubarak, 84 and ailing, may watch the election from a military hospital on the outskirts of Cairo as he awaits the verdict of his murder trial on June 2.

The former strongman is accused of involvement in the killing of some 850 protesters during the uprising and of corruption.
